Terms of Service

These Terms of Service ("Terms") govern your use of the Arcanum Wilds mobile application and any related services (together, the "Service"). By creating an account, installing the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About these Terms

Arcanum Wilds is an augmented-reality (AR) creature-taming mobile game. Players walk the real world, find magical creatures, tame them using rune-casting gestures, generate AI-rendered creatures and 3D habitats, and join social guilds. This document is a binding agreement between you ("you", "Player") and the Operator ("we", "us", "our").

We update these Terms from time to time. Material changes will be announced in-app and by the Effective date above. Continued use of the Service after the Effective date constitutes acceptance.

2. Eligibility & accounts

2.1 Age

You must be at least 13 years old to create an account.

  • If you are between 13 and 15 and reside in the European Economic Area, the United Kingdom, or another jurisdiction where the digital age of consent is 16, your parent or legal guardian must consent on your behalf and may be asked to verify this.
  • If you are between 13 and 17 anywhere else, your parent or legal guardian must permit your use of the Service.
  • We do not knowingly collect data from children under 13. If we learn that an account belongs to a child under 13, we will delete it.

2.2 Account creation

You agree to provide accurate registration information, keep your credentials secret, and notify us immediately if your account is compromised. One account per person. You are responsible for everything that happens under your account.

2.3 Guardian Mode

Where the Service offers a Guardian Mode (applied automatically for users below the local age threshold and optionally by adults), some features are restricted: chat may be emote-only, validation is limited to your guild, the Marketplace is disabled, and certain creature generation prompts are filtered more strictly.

3. Licence to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, solely for personal, non-commercial entertainment.

You agree not to:

  • copy, modify, reverse-engineer, decompile or create derivative works of the Service;
  • use bots, scrapers, automated agents, GPS spoofers or any tool that fakes location, motion or input;
  • scrape, harvest or extract data from the Service except via tools we explicitly authorise;
  • bypass rate limits, anti-cheat systems, or any technical restriction;
  • resell, rent, lease, sublicense or otherwise commercially exploit the Service;
  • access the Service through any account other than your own, or share your account.

We may revoke this licence at any time for breach of these Terms.

4. Real-world safety (AR play)

Arcanum Wilds is played in the real world. Your safety is your responsibility.

  • Be aware of your surroundings. Do not play while driving, cycling, or operating any vehicle or machinery.
  • Respect private property and laws. Do not trespass, do not enter restricted areas, do not violate local regulations to reach an in-game location.
  • Respect others. Do not play in cemeteries, places of worship, hospitals, schools (during hours), or any location where you are not welcome.
  • Be weather-aware. Stop play in dangerous conditions (storms, extreme heat, low visibility).
  • Mind young players. Minors must play under adult supervision.

We are not liable for any property damage, injury, death, fine, arrest, or other loss resulting from your real-world conduct while using the Service.

5. Generative AI content

The Service includes two generative-AI features:

  • Creature Creation Studio — text- and image-to-3D creature generation, powered by Meshy.ai.
  • Vault Habitats (Marble) — text-to-3D habitat scene generation, powered by World Labs Marble.

These features are made available subject to additional terms set by their respective providers. By using them, you also agree to the applicable provider terms in force at the time of generation.

5.1 Your inputs

You retain all rights you already had in the text prompts, reference images, and any other inputs you supply. By submitting them, you grant us and our generative-AI providers a worldwide, non-exclusive, royalty-free, sublicensable licence to process them for the purpose of producing the requested output and for operating, securing and improving the Service.

5.2 Your outputs ("Assets")

Subject to these Terms, you receive a perpetual, worldwide, non-exclusive licence to use the Assets generated from your prompts for personal, non-commercial purposes within the Service.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, perpetual licence to host, display, distribute, moderate, modify (for technical reasons such as compression or compositing), and let other Players view, interact with, and reference your Assets within the Service (for example, visiting your Vault, validating your discoveries, or competing for Featured placement).

We make no representation that any Asset is unique, copyrightable, or free of similarity to other Assets generated by you or other Players from comparable prompts. AI outputs are inherently probabilistic.

5.3 Prohibited prompts and outputs

You must not attempt to create, and must not request the Service to generate, any content that:

  • Sexualises minors in any form (immediate ban; we report to authorities where required by law);
  • is sexually explicit, pornographic, or fetishistic in any way;
  • depicts gratuitous violence, gore, torture or self-harm (we will refuse blood-splatter creatures, beheadings, and similar);
  • promotes terrorism, organised violence, or the glorification of attacks on people or groups;
  • is hateful, discriminatory or harassing against any race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristic;
  • depicts real persons, including public figures, in a defamatory, intimate, or deepfake context;
  • depicts trademarks, copyrighted characters, or branded logos that you do not have rights to;
  • is deceptive — designed to impersonate, defraud, or mislead other Players;
  • depicts functional weapons, drugs, or other illegal goods;
  • depicts religious symbols in a disrespectful or inflammatory context;
  • violates any applicable law in the Czech Republic, the European Union, or your jurisdiction.

We use automated and human moderation to filter prompts and outputs. We may refuse generation, remove Assets, suspend access to the studio, or terminate accounts that attempt prohibited generation, with no obligation to refund any Arcanium spent.

5.4 Validation

Submitted creature Assets enter a guild validation queue before becoming visible in the bestiary or marketplace. Guild members vote to approve or flag candidates against the quality and safety standards in section 5.3. We may override guild decisions where required to comply with these Terms or applicable law.

5.5 AI output is provided "as is"

AI outputs may be visually imperfect, similar to other outputs, factually inaccurate, or not what you intended. We do not warrant the quality, originality or fitness for purpose of any AI output. Use of any Asset outside the Service is at your own risk and may infringe third-party rights.

6. User-generated content (chat, names, messages)

In addition to AI-generated Assets, the Service lets you submit other content — guild names, habitat names, creature names, chat phrases, custom emotes (where enabled), feedback messages, ratings, profile information ("User Content").

6.1 Licence

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, perpetual licence to host, store, reproduce, distribute, modify (for technical reasons), publicly display, and otherwise use your User Content for the purpose of operating and promoting the Service.

6.2 Your representations

You represent and warrant that you own or have all necessary rights to submit your User Content and that it does not violate any third-party rights or applicable law.

6.3 Community standards for chat, guilds, and social features

You must not use any social feature (guild chat, validation comments, ritual lobby presence, vault visits, marketplace, feedback channel) to:

  • harass, bully, dox, stalk, threaten or intimidate any person;
  • use hate speech or slurs;
  • post sexually explicit content, sexual solicitation, or content involving minors in any sexual context;
  • post graphic violence, gore, self-harm content, or content glorifying suicide;
  • spam, advertise, solicit, or send unsolicited promotional messages;
  • impersonate any person, group, employee, moderator or the Operator;
  • post personal information of any other person without their consent;
  • share or solicit account credentials, cheats, exploits, or external trading offers (see section 7);
  • post links to malware, phishing, or illegal services;
  • evade prior bans, mutes or restrictions;
  • violate any applicable law.

Even where chat is restricted to canned phrases and emotes, you must not use phrases or emote combinations to convey prohibited content.

6.4 Reporting and moderation

We provide in-app reporting for creatures, vaults, chat messages, and player profiles. We review reports and take action which may include warnings, content removal, temporary mutes, account suspension, or permanent termination. We may act on our own initiative without a report. Repeat infringers will lose access.

7. Virtual currency, items, and economy

7.1 What "Arcanium" and "Arcane Essence" are

The Service uses two in-game resources:

  • Arcanium — the premium currency, sometimes purchased with real money (subject to your platform's payment terms).
  • Arcane Essence ("AE") — the soft currency, awarded through gameplay (taming, validation, ritual rewards).

Together, "Virtual Items" refers to Arcanium, Arcane Essence, tamed creatures, habitats, portal frames, cosmetics, and any other in-game asset.

7.2 No real-world value

Virtual Items have no real-world or monetary value. They are not currency, not a financial instrument, not a security, not a commodity, and not redeemable for cash or any real-world goods or services from the Operator, except as expressly required by mandatory consumer-protection law in your jurisdiction.

7.3 Licence, not ownership

You do not own Virtual Items. You are granted a personal, limited, non-transferable, revocable licence to use them within the Service. We may, at any time and at our discretion, regulate, modify, balance, suspend, or remove Virtual Items.

7.4 No real-money trading ("RMT")

You must not, and must not assist any other person to:

  • buy, sell, gift, trade, lease, lend, pledge, or otherwise transfer Virtual Items for real money, cryptocurrency, gift cards, services, or any other thing of real-world value;
  • operate or participate in any account-trading, account-sharing, account-boosting, or third-party item-broker service;
  • list Virtual Items or accounts on any external marketplace, auction site, forum, or messaging channel;
  • exploit any bug, glitch, or unintended mechanic to generate Virtual Items.

Real-money trading and account trading violate these Terms and may also violate applicable law. We may suspend or terminate accounts involved on either side of an RMT transaction, void affected Virtual Items, and refuse refunds, regardless of which Player initiated the transaction.

The in-game Marketplace allows trading of creatures for Arcane Essence only under the rules surfaced in-app. That in-game marketplace is the only authorised trading venue.

7.5 Purchases and refunds

All in-app purchases are processed by the Apple App Store. Their refund policy and consumer terms apply. We do not process purchases or refunds directly.

Where applicable consumer-protection law gives you a statutory right of withdrawal (for example, the EU Consumer Rights Directive's 14-day cooling-off period for digital content): the right does not extend to digital content already delivered with your express consent and acknowledgment that the right of withdrawal is thereby waived. You give that consent when you confirm an in-app purchase.

7.6 Account closure or service termination

If your account is closed (by you or by us) or the Service is discontinued, unused Virtual Items are forfeited, except where mandatory law requires otherwise. We will give a minimum of 30 days' notice in-app or by email before discontinuing the Service in a way that materially affects active Players.

8. Intellectual property

We (and our licensors) own all rights in the Service, including the app, server, brand, logos, written text, code, gameplay systems, music, sound effects, character designs we ship as seed creatures, the wizard-guide characters, the portal-frame artwork, and the rune set. Nothing in these Terms grants you any right in our intellectual property except the limited licence in section 3.

You may share screenshots and short video clips of your own gameplay on social media for non-commercial purposes. Larger commercial use (streaming for revenue, video monetisation, merchandise) requires our prior written permission.

Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to hejtmi@gmail.com with the information required by the EU Digital Services Act (DSA), and where applicable the US DMCA: identification of the work, location of the infringing material on the Service, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorised to act. We respond to valid notices and operate a repeat-infringer policy.

9. Privacy, location and biometrics

The Service collects and processes personal data, including precise GPS location, motion-sensor data, camera frames for AR placement, and account information. Processing is governed by our Privacy Policy (in-app and on the website). By using the Service you consent to that processing.

Camera frames used for rune-tracking and AR encounters are processed on-device where possible. AR scans submitted to the Habitat Studio may be sent to our generative-AI providers for processing under their respective terms.

10. Beta and TestFlight

If you participate in a TestFlight, closed beta, or other pre-release programme:

  • The Service is provided as a work in progress. Features may break, change, or be removed without notice.
  • Virtual Items earned during beta may be reset between phases. We will warn you before a reset.
  • You agree to provide feedback via the in-app feedback button or designated channel.
  • You agree not to publicly disclose, screenshot, or stream beta-only content marked as confidential.

The remaining sections of these Terms apply to beta participation.

11. Suspension and termination

We may, at our discretion, warn, mute, suspend, terminate, or refuse service to any account for any violation of these Terms, any applicable law, or for conduct that we reasonably believe is harmful to other Players or to the Service. We may act with or without notice.

You may close your account at any time from Profile → Account → Delete account. Closing your account does not entitle you to a refund of unused Virtual Items except where mandatory law requires otherwise.

Sections 4 (Real-world safety), 5.5 (AI output as-is), 7 (Virtual currency), 8 (Intellectual property), 12 (Disclaimer), 13 (Liability), 14 (Indemnification) and 15 (Disputes) survive termination.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, security, or that the Service will be uninterrupted, error-free, virus-free, or that defects will be corrected.

We do not warrant that AI-generated outputs will be original, accurate, unique, non-infringing, or fit for any particular purpose.

Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions apply to you only to the extent permitted.

13. Limitation of liability

To the maximum extent permitted by law, the Operator and any of its agents, contractors and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service.

Our total cumulative liability for any and all claims related to the Service is limited to the greater of: (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) twenty euros (€20).

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory law overrides these limits, they apply to you only to the extent permitted. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Operator from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Service;
  • your User Content or AI prompts/outputs;
  • your breach of these Terms;
  • your violation of any third-party right (including intellectual-property, privacy, and publicity rights);
  • your real-world conduct while using AR features.

This obligation does not apply where prohibited by applicable consumer-protection law.

15. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Czech Republic, excluding its conflict-of-laws rules.

15.1 EU / EEA consumers

If you are a consumer in the European Union or EEA, you also benefit from the mandatory protections of the law of the country in which you live. Nothing in these Terms removes those mandatory protections.

The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, which you may use to submit consumer disputes.

15.2 Forum

Subject to mandatory consumer rules, any dispute will be submitted to the competent courts of the Czech Republic at the seat of the Operator.

15.3 Informal resolution first

Before filing any claim, you agree to contact us at hejtmi@gmail.com and to make a good-faith effort to resolve the dispute informally for at least 30 days.

16. General

  • Entire agreement — these Terms, the Privacy Policy and any in-app notices form the entire agreement between you and us regarding the Service.
  • Severability — if any provision is held unenforceable, the remainder remains in effect.
  • No waiver — failure to enforce a right is not a waiver of that right.
  • Assignment — you may not assign these Terms; we may assign them to a successor in interest (for example, an entity I incorporate that takes over operation of the Service).
  • Notices — we may give notice via in-app message, push notification, or email to the address on your account.
  • Language — the English version of these Terms prevails in case of conflict with any translation.
